Release and Waiver of All Liability and Assumption of Risk Agreement
I acknowledge that I am donating my time and services as a volunteer at the 2019 PNC Father Son Challenge (the “Tournament”) being held at The Ritz-Carlton Golf Club, Orlando (the “Club”) without the expectation of payment and understand that I will not be compensated in connection with the Tournament. I acknowledge that I am not an employee of the Club, the PGA TOUR, IMG Worldwide, LLC (“IMG”), NBC, the Golf Channel or any sponsor of the Tournament. I agree that I will perform volunteer services for no more than seven hours a day. I agree to comply with all Tournament and Club rules.
In connection with my activities as a volunteer at the Club for the Tournament, I agree and understand that my presence at the Tournament and any volunteer work or services performed by me for the Tournament, its sponsors, the Club, PGA TOUR, IMG, NBC, the Golf Channel, their respective affiliates and subsidiaries and their respective officers, directors, agents, members, employees and officials as well as any other volunteer (collectively, “the Indemnified Parties”), may expose me to both known and unanticipated risks of harm or injury. In consideration of and as a prerequisite to my participation as a volunteer, I, for myself, acknowledge that such risks exist, hereby assume all such risks, and release and discharge the Indemnified Parties and each of them from any and all claims for liability for personal injury (including death) and property damage that I may suffer while performing such volunteer work or service, whether or not on the premises of the Club, including, without limitation, any claim arising out of any condition of the premises owned by the Club or used by IMG, the PGA TOUR, NBC or the Golf Channel for, or the conduct of any person in connection with, the preparation for, supervision of or conduct of the Tournament or any practice round or activity connected or related to it. I further understand that the Indemnified Parties may not maintain insurance which will cover me for personal injury, property damage or medical expenses, and I accept full responsibility for the costs of treatment for any injury or damages suffered by me while participating as a volunteer in connection with the Tournament. I further agree that in case any action being brought for or on behalf of myself on account of any injury or damage sustained by me while volunteering in connection with the Tournament, I will be personally responsible to, and agree to repay to, any of the Indemnified Parties and hold each of them harmless against any amounts recovered in connection with any such action and all related costs incurred.
I have fully informed myself of the contents of this release by reading it and agree to be bound by the terms set forth herein in consideration for performing volunteer services. By finalizing and processing the completed application, I acknowledge that:
- IMG (or a third party on behalf of IMG) may undertake a check of my background;
- My volunteer position is not guaranteed, nor if granted, guaranteed for any length of time and that the Club, the PGA TOUR, IMG, NBC and/or the Golf Channel may deny or end my volunteer opportunity at any time, for any reason, with or without prior notice.
- I give the Tournament, the Club, the PGA TOUR, IMG, NBC and the Golf Channel the right to use, re-use, publish and republish my name and biographical material about me and photographic portraits, pictures or video of me, or in which I may be included in whole or in part, or composite or distorted in character in archival or advertising print media and/or footage in perpetuity.
- The Club, the Tournament, the PGA TOUR, IMG, NBC and the Golf Channel do not discriminate in the selection among volunteer applications on the basis of race, sex, color, creed, age, national origin, religion, or disability.
If any provision of this Agreement is determined to be legally unenforceable or void, such unenforceable or void provision shall not affect the legality, validity or enforceability of the remaining provisions hereof and may be severed from the remaining provisions as appropriate, to the extent permitted by law.
I agree that any and all disputes arising hereunder or with respect to this Release and Waiver shall be submitted to final and binding arbitration, before a single arbitrator, in accordance with the JAMS Commercial Arbitration Rules & Procedures. The arbitration award in any such arbitration may be confirmed by any court of competent jurisdiction. Any such arbitration shall take place in the state of Florida. Notwithstanding the foregoing, I acknowledge and agree that I may be asked to enter into a separate Arbitration Agreement with IMG and such Arbitration Agreement, when executed, shall take precedence only to the extent it conflicts with one or more terms contained in this release and waiver.
